There are legal implications in attendance management. These mainly concern employment law but also touch on equal opportunities. This training activity will outline key areas and highlight specific elements of employment law relevant to attendance management.
You begin this training activity with an introduction. The participants then work in groups to consider what can make a dismissal unfair. You review their ideas and emphasise the key points of unfair dismissal and employment tribunals. The participants again work in groups to discuss two different case studies. You then introduce an exercise in which participants define the grounds on which an individual could be discriminated against in the work place. Next, they work in groups to define disability. You review their ideas and explain the Disability and Discrimination Act (1995). The participants then work individually to asses a disability discrimination case study. Finally, you review the case study result before summarising the training activity and closing the session.
Who is it for: While this training resource is not designed to be a legal guide, it is intended for use by trainers to make participants aware of some of the issues that may arise. The training activity outlines key areas and uses case studies to demonstrate the points.
