Use this training activity to define constructive dismissal and ensure your participants understand the concept, in order to avoid any situations that might lead to such a claim.
It is important that managers of people at every level in an organisation should be aware of the concept of constructive dismissal, so that situations which might lead to such a claim can be avoided. This training activity asks participants to explore the concept of constructive dismissal to help them to appreciate the importance of being fair and reasonable at all times. Participants work in groups of three or four, to determine whether the individual in the case study might be able to bring a claim for constructive dismissal. You must explain the concept and control the feedback session so that participants realise how important it is to avoid becoming vulnerable to a claim for constructive dismissal. The training activity is quick and easy to run, but participants will need some understanding of fair and unfair dismissal if they are to fully appreciate what is meant by constructive dismissal.
