Introduce the training activity by explaining the importance of adhering to the three-step statutory procedure when dealing with serious disciplinary matters. Emphasise the fact that non-adherence to the statutory procedure can result in claims of unfair dismissal, which can be very costly to the organisation.
This training activity uses a case study to demonstrate that there are serious consequences if statutory procedures are not followed in disciplinary cases that result in formal action. There is a three-step procedure for most cases involving demotion, loss of pay or status or dismissal, and a two-step procedure for cases resulting in dismissal through gross misconduct. If these are not followed, the result can be costly for the organisation. Participants read the case study and make brief notes on the different actions of the manager, before identifying whether or not the employee has a case for appeal under the three-step statutory procedure. The training activity requires an initial introduction to the three-step statutory procedure and then the trainer facilitates the feedback session and debrief. Participants work in small groups to complete the training activity.
